Draft for legal review. This document was written by the FASHIONDEALS team to describe how the service actually works. It has not yet been reviewed by external counsel and is not legal advice. We recommend that a qualified lawyer in your jurisdiction review it, and that the items in [[brackets]] (company details and points marked [[Confirm with FASHN]]) are completed before launch.
What virtual try-on is
Virtual try-on lets you see a garment on yourself. There are two modes: (a) the on-device scan and try-now, which estimates body proportions and fits a garment overlay entirely in your browser; and (b) the optional photo-real render, where a generative image service produces a realistic image of you wearing the item. Both are illustrations, not a promise of fit, colour or drape.
Consent and who can use it
You use try-on only if you choose to, and we ask for your permission before any photo is sent anywhere. Because photos and body measurements can be biometric or sensitive personal data in some jurisdictions (for example Illinois BIPA, Texas CUBI, the EU/UK GDPR and the UAE PDPL), we rely on your explicit consent, which you can withdraw. Only upload photos of yourself, or of someone who has clearly agreed. Do not upload photos of children. The photo-real render is available to people aged 18 or over.
On-device scan and try-now
The body scan and the try-now overlay run in your browser using AI libraries and models loaded from public content delivery networks. Your photo and measurements stay on your device (in memory and, for your convenience, in the browser’s IndexedDB database fd). We do not receive them. Clearing browser storage, or Delete my try-on data in your account/settings, removes them.
Photo-real render with FASHN
If you choose the photo-real render, we forward your photo (sent as base64 over an encrypted connection through our server so our API key stays secret) and the garment image from the catalogue to FASHN (fashn.ai), our rendering provider, for that single request. What we know about our own handling, as built today:
- Your person photo is not stored by FASHIONDEALS; it is forwarded for the request and not saved in our database.
- We ask FASHN to return the result as an image file directly, so the provider holds it only briefly, and we copy the result into our own storage so you can retrieve it, because the provider deletes outputs after about 3 days.
- Unsaved results are deleted from our storage after 3 days. If you are signed in and choose Save (wardrobe) or Build my model, those images are kept until you delete them or delete your account.
- We do not use your photos or results to train models, and we do not share them with anyone except FASHN as above.
- Daily fair-use limits apply to protect the service.
What we still need to confirm with the provider and will state here before launch: how long FASHN retains uploaded inputs and outputs on its systems, whether it uses inputs to train or improve models, where it processes data, and its sub-processors. [[Confirm with FASHN]] Until confirmed, treat the provider’s own terms and privacy policy as the authority for what happens on its side.
“My model” and wardrobe (signed-in)
If you sign in you can create a reusable model of yourself and save looks. These are stored in your account and visible only to you. You can remove individual looks, or delete your model and all saved try-on images at any time (Delete my model); deleting your account removes them too.
Fit profile and size suggestions
If you save a fit profile (size, height, fit preference) it is stored on your device and, if you are signed in, in your account. Size suggestions are estimates based on that profile and the store’s size information; use the size guide and the store’s own notes before buying.
Your rights and how to delete
You may access, delete or withdraw consent for your try-on data at any time: use the controls in your account, clear your browser storage for on-device data, or contact [[Contact email]] (privacy/DPO: [[DPO email]]). See the Privacy policy for rights under GDPR, UK GDPR, CCPA/CPRA, the UAE PDPL and the Indian DPDP Act.
Limits and acceptable use
Do not upload unlawful, explicit or misleading images, or images that you do not have the right to use. We may block abusive use. AI-generated images may contain errors or artefacts and are labelled as try-on previews.
