Draft for legal review. This document was written by the FASHIONDEALS team to describe how the service actually works. It has not yet been reviewed by external counsel and is not legal advice. We recommend that a qualified lawyer in your jurisdiction review it, and that the items in [[brackets]] (company details and points marked [[Confirm with FASHN]]) are completed before launch.
Our approach
Product images and descriptions on FASHIONDEALS come from stores’ public feeds and are shown to help shoppers compare; user submissions are limited. We respect intellectual property and act promptly on valid notices under the US Digital Millennium Copyright Act (17 U.S.C. §512), the EU Digital Services Act and equivalent laws.
Designated agent
Notices should be sent to our designated agent: [[Designated copyright agent name]], [[Company legal name]], [[Registered address]], email [[Contact email]]. [[DMCA agent registration number, if registered with the US Copyright Office]].
How to send a notice
Send an email with the subject “Takedown notice”. A valid notice includes:
- Your name, postal address, telephone number and email address.
- Identification of the copyrighted work you claim is infringed (or a representative list).
- The exact page address(es) (URLs) on FASHIONDEALS where the material is, with enough detail for us to find it.
- A statement that you have a good-faith belief that the use is not authorised by the owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act for the owner.
- Your physical or electronic signature.
Knowingly misrepresenting that material is infringing may make you liable for damages. Incomplete notices may not be actionable.
What we do
We review the notice. Where it is valid we remove or disable access to the material and may tell the store or user concerned. Because most images are hosted by the store and shown via our links, the fastest fix is often also to contact the store; we will help where we can.
Counter-notice
If you believe material was removed by mistake or misidentification, send a counter-notice with: your name, address, telephone and email; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; consent to the jurisdiction of the courts of your district (or, outside the US, of [[Jurisdiction]]) and that you will accept service of process from the complainant. We may restore the material in 10–14 business days unless the complainant tells us it has started court action.
Repeat infringers
Where appropriate, we end access for users who repeatedly infringe copyright.
How we collect data
We read product information from publicly available feeds and pages, respecting robots.txt and rate limits. If you run a store and want us to stop or change how your catalogue appears, write to [[Contact email]].
Other rights and illegal content
For trademark concerns see the IP and trademark notice. To report content you believe is illegal or in breach of our Community guidelines, use the same address; we will review it, tell you the outcome and offer a way to appeal where required.
